Welcome to EchoLegacy.life (“we,” “us,” “our,” or “EchoLegacy”). These Terms of Service (“Terms”) govern your access to and use of our website echolegacy.life, mobile applications (if any), and related services (collectively, the “Service”), which enable you to create interactive digital legacies (avatars) by recording your voice, video, stories, memories, and other personal content while alive, for secure preservation and authorized family interaction.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using it, you represent that you meet this requirement and have the legal capacity to agree to these Terms.
2. Accounts and Registration
- To create a legacy avatar, you must register an account with accurate information.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- We reserve the right to suspend or terminate accounts for violations of these Terms or for security reasons.
3. Our Service
EchoLegacy allows you to:
- Record voice/video responses to guided prompts about your life, stories, advice, memories, etc.
- Build an interactive AI-powered avatar based solely on your provided content (using retrieval and generation to enable natural conversations in your voice/style).
- Authorize specific family members or contacts to interact with your avatar.
- Update or add content over time while alive.
- Control access, pause, retire, or delete the avatar at any time.
The avatar is not a full resurrection or independent entity—it’s an interactive archive of your recorded content, enhanced by AI for accessibility. Outputs may not always be perfectly accurate (e.g., due to AI limitations); we make no guarantees on exact replication of thoughts or future predictions.
4. User Content and Ownership
- You retain all ownership rights to your uploaded/recorded content (“User Content”).
- By using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify (for formatting/AI processing), display, and make available your User Content solely to provide and improve the Service (e.g., generating avatar responses).
- This license ends when you delete your account/content or upon termination (except for backups purged per our retention policy).
- You represent that your User Content does not infringe third-party rights (e.g., no unauthorized photos/voices of others without consent).
- We do not claim ownership of your User Content and will not use it for unrelated purposes (e.g., no training external models without explicit opt-in consent).
5. Authorized Access and Post-Death Use
- You control who accesses your avatar (via invitations/links).
- Access continues after your passing only if you explicitly set it up that way while alive.
- Authorized users must comply with these Terms; misuse (e.g., harassment via avatar) may result in revocation.
- We provide no automatic post-death triggers (e.g., no “heartbeat” detection); activation is manual via your instructions.
6. Payments
- The Service operates on a one-time payment model for lifetime access (pricing displayed at checkout).
- Payments processed via secure third-party providers (e.g., Stripe); we do not store full payment details.
- All sales are final; no refunds except as required by law or within any trial/refund window stated.
- You are responsible for any taxes.
7. Prohibited Conduct
You agree not to:
- Use the Service for illegal, harmful, or abusive purposes.
- Attempt to reverse-engineer, scrape, or interfere with the Service.
- Impersonate others or create avatars without full consent.
- Upload harmful content (viruses, spam, hate speech).
- Violate any laws or third-party rights.
8. Intellectual Property
- The Service (including AI tech, design, trademarks) is owned by EchoLegacy or licensors.
- Limited license granted to you for personal, non-commercial use.
9. Disclaimers and Limitations of Liability
- The Service is provided “AS IS” without warranties of any kind (express or implied), including accuracy, reliability, or fitness for a particular purpose.
- AI-generated responses may contain errors, hallucinations, or unintended outputs—we are not liable for emotional distress, misinformation, or decisions based on avatar interactions.
- In no event shall EchoLegacy’s liability exceed the amount you paid us (if any).
- We are not liable for indirect, consequential, or punitive damages (e.g., loss of data, emotional harm, business interruption).
- Some jurisdictions limit these disclaimers—yours may apply.
10. Indemnification
You agree to indemnify and hold us harmless from claims arising from your User Content, misuse of the Service, or violation of these Terms.
11. Termination
- You may terminate your account anytime (deleting content/avatar).
- We may terminate/suspend for violations, with or without notice.
- Upon termination, access ends; content may be deleted per our Privacy Policy.
12. Governing Law and Dispute Resolution
These Terms are governed by Florida law (without conflict principles). Any disputes resolved in courts of Sarasota County, Florida. You agree to waive jury trial where permitted.
13. Changes to Terms
We may update these Terms. Changes posted here; continued use constitutes acceptance. Material changes notified via email if you have an account.
